In the news this week, a female Cambridge graduate who gave up her career to stay at home to care for her is awarded £400,000 compensation from her husband on top of equal share of the couple’s £10m assets.

What is relationship-generated disadvantage?

Compensation for relationship-generated disadvantage is financial relief paid on divorce, nullity or judicial separation.

It is most often applied when one party has given up a lucrative career to care for children.

The compensation recognises that the individual may have seriously damaged their own ability to earn an independent living for the greater good of the family.

Even if their future needs have been generously met, it may be that they are entitled to look to the other party in the relationship for a share of their surplus income to be paid by way of compensation
